The Moscow City Public Health Ministry "Psychiatric Hospital No. 14 of the Moscow City Health Department" decided to unilaterally abandon the state contract concluded with the Limited Liability Company "SATURN-ShBC-3" (Group of Companies "GUD-FOOD"), specializing on the organization of food in social institutions, which threatened the last inclusion in the Register of bad-faith suppliers for a period of two years.
Disagreeing with the decision of the state customer, lawyers of the company "Lawful Business" filed an application to the Arbitration Court of Moscow. By a counter-claim, the state customer insisted on the recovery of a contractual penalty of more than 5 million rubles. During the trial, the lawyers of the Law Center "Lawful Business" were able not only to prove the groundlessness of the decision of the state customer, thereby recognizing it as invalid, but also to terminate the state contract on the initiative of the contract service provider, having recovered the debt under the contract from the state customer. In the counter claim of the state customer was refused in full.
