WE WON THE DISPUTE OF JSC "ROSTELECOM" ON THE FAILURE OF THE STATE CONTRACT IN THE AMOUNT OF 1.5 BILLION RUBLES

Legal Business Solution successfully protected interests of Joint Stock Company “Rostelecom” in the Arbitration court.

The essence of the dispute: the public sector customer refused to accept works under the contract, constantly making claims for the quality of work performed.

Due to the delay in the execution of works, the public sector customer filed a claim to the court about collecting of the penalty for the late execution of the contract.

Legal Business Solution lawyers managed to prove the fact of acceptance of the work regardless of signing or not signing the act, to determine the fact of violation of the customer’s obligations. In this regard, the parties decided to enter into a settlement agreement that was approved by the Arbitration court of Krasnodar region with the support of our lawyers.

By the conclusion of a settlement agreement with the Department of Informatization and communications of Krasnodar region JSC "Rostelecom" managed to avoid penalties and termination of the contract, and receive funds for performed work under government contract.

WE WON THE DISPUTE OF LLC “ITTS” SKANEX” UNDER THE STATE CONTRACT IN THE AMOUNT OF 1.3 BILLION RUBLES

Our lawyers won the lawsuit and helped to avoid unreasonably imputed to penalties for violation of the state contract for a total amount of 1.5 billion rubles.

The essence of the dispute: the public sector customer unreasonably didn’t sign the act of acceptance of works under the state contract at the time of acceptance of the work by identifying many defects in the work, therefore, sought the payment of penalties in the amount of 108 million rubles for the delay in execution of works. The situation was complicated by the fact that the SKANEX ITTS was forced to sign the act of acceptance of works date later than assumed under the contract, formally recognizing the right of the state customer.

Legal Business lawyers managed to prove the fact of delivery of works, regardless of the date of signing of the act, to contest the payment of penalties in full. The dispute has been completed in favor of our client in Federal Arbitration court of the Moscow district.

SUCCESSFUL REPRESENTATION OF INTERESTS OF JSC "MOSOBLGIDROPROEKT" IN RECOGNITION IT ENVADED FROM THE CONCLUSION OF THE CONTRACT

Directorate of state customer of development programs of sea transport recognized JSC "Mosoblgidroproekt" (subsidiary company of JSC "RusHydro") evaded from signing of the contract. The public sector customer sent the information about the client to the office of the Federal Antimonopoly Service to incorporate information about JSC "Mosoblgidroproekt" in the Register of bad-faith suppliers.

Legal Business Solution represented the client's interests in FAS, where it was possible to prove that the customer has not fulfilled its obligations and the not signing of the contract was not the fault of JSC "Mosoblgidroproekt". Information was not included in the Register of bad-faith suppliers. The customer has challenged this decision in arbitration court. Legal Business Solution represented the interests of JSC "Mosoblgidroproekt" in Arbitration court of Moscow, the dispute is won in full.

WE WON THE DISPUTE OF “TD BLISS” LLC THE SUBSIDIARY COMPANY OF C-AIRLAID LLC IN KARELIAN FAS.

GBUZ "Republican oncological dispensary" submitted the application to FAS in the Republic of Karelia on the inclusion of information about "TD BLISS" in the Register of bad-faith suppliers as a party of state procurement that violate the provisions of a government contract. Legal Business Solution lawyers proved the groundlessness and illegitimacy of requirements of the state customer, so the information about "TD BLISS" was not included in the Register of bad-faith suppliers.

We won in a dispute between CJSC «RosTehno» and the Ministry of Fuel and Energy of the Republic of Crimea in the Crimean FAS

The Ministry of Fuel and Energy of the Republic of Crimea has filed an application to the FAS for considering the inclusion of information about the major car dealer in Krasnodar CJSC „RosTehno“ in the register of unfair suppliers.

The lawyers of «Legal Business Solutions» could prove groundlessness of the claims of the state customer, defended the interests of the client and saved the business reputation of CJSC «RosTehno».

Thanks to well-formed legal position, the information about CJSC «RosTehno» was not included in the register of unfair suppliers.

WE CLOSED THE TRANSACTION OF SALE OF THE BRANCH RADIOELECTRONICS PLANT IN THE TULA REGION.

This project was implemented from scratch and prior receipt the result: certificate of ownership of the plant. Plant is 3 Hectares of land and 18 500 sqm of buildings and structures, including a complete set of communications (800 KW electricity, canalization, water, gas at the border, boiler room) were in Federal ownership.

It was received the decision to sell the plant, was made the assessment and conducted the auction, our Client was voted the winner of the auction and acquired the ownership of a unique object – the former closed the factory of electronics located in the woods with all utilities.

WE PROVIDED LEGAL SUPPORT IN THE REORGANIZATION OF THE SLOVENIAN ISKRATEL GROUP IN RUSSIA.

Our company conducted the closing of several subsidiaries, the transfer of assets to factory of group of companies in Ekaterinburg, carried out legal support of the establishment of service centers, supported contractual activities, collected debit debts, including international contracts in the international commercial arbitration court at the Russian chamber of Commerce, worked with credit debts, and provided full legal support of activity of group of companies Iskratel in Russia.

WE CARRIED OUT FULL LEGAL SUPPORT OF THE PROJECT ON CONSTRUCTION OF A PLANT FOR THE EXTRACTION OF RELICT MINERAL SAPROPEL IN THE TVER REGION.

Legal Business Solution effected a purchaseof land 64 Ha, obtained a license for subsoil use, a water use permits, and after the construction of the plant, secured the rights to the technology and trademarks ArganiQ and Happy Plant.

Contractual support of introducing products to market was conducted.

The result is that the production of the plant now is in leading retail chains: OBI, Leroy Merlen, Metro, Castorama, SedmoiKontinent, SPAR and others.

The plant's products are shipped abroad in EU countries.
